1. Introduction

Welcome to the insect identification quiz and mobile application (“Service”) provided by PICTURE & PHOTO IDENTIFIER COMPANY LTD (“we,” “us,” “our”). We are a company registered under the laws of Cyprus, with our registered address at:

These Terms & Conditions (“Terms”) govern your access to and use of the Service, which includes:

• Our web-based quiz leading to insect/spider photo submission
• The mobile application(s) where you can manage subscriptions, upload insect photos for AI-based recognition, and view results
• Any other tools, features, or content we provide as part of the Service

By accessing or using the Service, you agree to be bound by these Terms, as well as our accompanying Privacy Policy. If you do not agree to any of these Terms, you may not access or use our Service.

2. Acceptance of Terms and Modifications

1. Legal Agreement. These Terms form a binding legal agreement between you and PICTURE & PHOTO IDENTIFIER COMPANY LTD. By using the Service, you acknowledge that you have read, understood, and agree to abide by these Terms.
2. Updates to Terms. We reserve the right to modify these Terms at any time. If changes materially affect your rights, we will provide notice (e.g., via email or in-app prompt). Continued use of the Service after such modifications indicates acceptance of the revised Terms.
3. Supplementary Policies. Our Privacy Policy forms part of these Terms and outlines how we collect, store, use, and disclose your information.

3. The Service Overview

Our Service enables you to:

• Take a Quiz: Through a web-based quiz, you answer questions about pests or insects/spiders you might be dealing with.
• Upload a Photo: At the final stage of the quiz, you are prompted to upload a photo for possible identification.
• Subscription and Email Confirmation: After the quiz, you receive a prompt to subscribe via a paywall. You then confirm your email address and receive instructions on downloading our app.
• Download and App Login: Using the link sent by email, you download our mobile application and log in with your email. This process links your quiz data and photo to your new app account.
• Insect Identification: Once in the app (and after subscription activation), you can submit or re-upload the insect/spider photo and obtain AI-based identification results.

Important: The identification results are only available through the mobile application after you complete your subscription purchase and link your email. The web quiz does not provide final identification results.

4. Disclaimers and Scope of Use

1. No Guarantees of Accuracy. While our AI technology can identify over 14,000 species of insects and spiders with a high degree of accuracy, we do not guarantee that any identification is 100% accurate or complete.
2. No Medical or Health Advice. We do not provide diagnoses of bites or any medical advice. Our Service is purely informational and educational.
3. No Pest Control Guarantee. Recommendations or content about pest control or potential toxicity are offered for general informational purposes only.
4. External Links and Resources. Our Service might contain links to third-party resources (e.g., websites, articles). We do not endorse or assume responsibility for them.

5. Eligibility and Age Restrictions

1. Eligibility. You must have legal capacity to enter into a binding contract and not be barred by applicable laws.
2. Age Requirement. Service is not intended for individuals under 16. If between 16–18, review with a parent or guardian who agrees on your behalf.

6. Account Registration and Security

1. Account Creation. You must create an account to access full features. Provide accurate and up-to-date information.
2. Confidentiality of Credentials. You are responsible for maintaining confidentiality and must notify us of breaches.
3. Single-Use Account. Each account is for a single user. Sharing credentials is not allowed beyond permitted use.

7. Subscription Plans and Payment

• Monthly Plan with Paid Trial Week: $8.95 for trial week, then $28.95/month auto-renew.
• Monthly Plan with 50% Discount: $14.95 for first month, then $28.95/month auto-renew.
• Quarterly Plan with 50% Discount: $28.95 for first quarter, then $56.95/quarter auto-renew.

Auto-Renewal: Subscriptions renew unless canceled 24h before end of billing cycle.

1. Payment Processing: Handled via third-party providers (Stripe, Apple, Google). We don’t store payment details.
2. Refunds:
   • In-app purchases: Refunds handled by the respective stores.
   • Web purchases: Stripe policies apply. 30-day full refund guarantee. Contact: niro.identification@gmail.com
3. Cancellation:
   • App purchases: Cancel via Apple ID or Google Play.
   • Web: Contact us by email. Deleting the app doesn't cancel subscription.

8. User Content and Conduct

1. User Content: You may upload photos and responses. You confirm rights to use the content.
2. Prohibited Content: No offensive, illegal, or inappropriate content.
3. Limited License: We may use uploaded content to provide and improve the Service.

9. Data Collection, Usage, and Privacy

See Privacy Policy for how we handle your data: email, photo, location, quiz responses. Retention is indefinite unless you request deletion. Emails may be used for marketing (you can unsubscribe). We use third-party services (e.g., Stripe, Analytics).

10. Intellectual Property

1. Our IP: We own all rights to the Service including AI models and software.
2. Restrictions:
   • No reverse-engineering, copying, public display, or IP infringement.

11. Disclaimers and Limitation of Liability

1. No Warranties: The Service is “as is” and “as available”.
2. Indemnity: You agree to defend and hold us harmless from claims arising from your use.
3. Limitation: We are not liable for indirect, incidental, special, or consequential damages.

12. Termination

1. By You: You can stop using the Service and cancel your subscription.
2. By Us: We may suspend or terminate access if Terms are violated.
3. Effects: Access ends immediately; some sections survive termination.

13. Governing Law (Optional)

We do not specify jurisdiction unless required. Disputes will follow applicable laws.

14. Miscellaneous

1. Entire Agreement: These Terms + Privacy Policy = full agreement.
2. Severability: Invalid terms don’t affect the rest.
3. No Waiver: Our choice not to enforce a term doesn’t waive our right.
